Sweepstakes Official Rules

The following Sweepstakes is intended for participants in the United States and Canada (excluding residents of Quebec) and shall be construed and evaluated according to the laws of the United States.

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON. You understand that you are providing your information to Tourism Corporation Bonaire, Kaya Grandi 2, Bonaire, Dutch Caribbean (“Sponsor“). The Sweepstakes Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at https://bonaireisland.com/privacy-policy/.

1. Eligibility:

No purchase necessary. Open to legal residents of the 50 United States and the District of Columbia, (“U.S.”) and Canada (excluding Quebec) (collectively the “Participating Market”), who are at least 18 years of age or older (OR THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE, WHICHEVER IS OLDER), who plan to attend one of the three Flash Flamboyance events, as later described in these Official Rules, and are physically located in the Participating Market during the Sweepstakes Period at the time of entry (“Entrant”). The Flamingo Flamboyance (the “Sweepstakes“) is governed by US law and is subject to all applicable federal, and state laws and regulations. Employees, officers and directors of Sponsor, Cohen-Friedberg Associates, LLC (“Administrator”), Dunn &Co., and their respective parents, affiliates, subsidiaries, advertising, promotion and fulfillment agencies (collectively, the “Promotion Entities”) and members of the immediate family or household of each are not eligible to participate. Immediate family member is defined as a parent, sibling or any person residing in same household as employee of the Promotion Entities.

This Sweepstakes is void where prohibited by law or regulation.

2. Agreement to Official Rules:

Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and legally binding in all respects.

3. Timing:

There will be three (3) unique entry and drawing periods, one per Flash Flamboyance Event. LIMIT: You may only enter one (1) Event per person or household. LIMIT: One (1) prize per person or household.

    • Entry starts at 12:01 ET 9/16/23
    • Entry ends at 11:59:59 p.m. ET  9/30/23

    • Number of Prizes to be won: 1
  • Flash Flamboyance Miami
    • Entry starts at 12:01 ET 9/30/23
    • Entry ends at 11:59:59 p.m. ET  10/14/23
    • Anticipated Drawing Date: 10/18/23
    • Number of Prizes to be won: 1

The Sponsor’s designated computer server is the official time-keeping device for the Sweepstakes.

4. Winner Section & Notification:

Random drawings will be conducted by the Administrator, based on the schedule listed in Rules #3 above, from all eligible entries received during the relevant Event. Potential Prize Winner will be notified by email or phone within three (3) business days of the applicable winner selection date (“Prize Notification”) and will be required to respond and provide all required information in order to receive their prize. Potential winner must reply within four (4) business days of first notification. Sponsor and Administrator, shall have no liability for any notification that is lost, intercepted or not received for any reason.

If, despite reasonable efforts, any potential winner does not respond within four (4) business days of the first notification attempt, or if prize notification is returned as unclaimed or undeliverable, such potential winner will forfeit the prize and at Sponsor’s discretion, an alternate potential winner may be selected. If any potential winner is found to be ineligible or if the potential winner has not complied with these Official Rules or declines a prize for any reason, such potential winner will be disqualified and at Sponsor’s discretion and, an alternate potential winner may be selected. The alternate winner will be randomly selected from all remaining eligible entries (“Alternate Winner”).

If a winning entrant is from Canada, entrant will be required to first correctly answer a mathematical skill testing question without assistance of any kind (whether mechanical or otherwise) within a 2-minute time limit in order to be eligible to win the prize. The question will be administered by phone or via the Declaration within two (2) business days following the drawing. If entrant cannot be contacted and the skill testing question administered, the prize will be forfeited and an Alternate Winner will be selected.

5. Prizes: Each Event drawing will award the following prize:
    Prize: Trip for two (2) to Bonaire in the Dutch Caribbean.

  • Roundtrip (coach class) air transportation from either New York City (via United Airlines), or Miami (via American Airlines) or Toronto (via NetJets) to Bonaire (“collectively the “Participating Hubs”). City of departure will be determined by each event drawing. For clarity, the potential winner in the Flash Flamboyance NYC will depart from the NYC-designated airport.
  • Five (5) Nights’ (double occupancy) hotel accommodations
  • Trip must be taken within one (1) year of award date and is subject to change based on the state of the COVID-19 pandemic travel conditions and restrictions as determined by the Sponsor in its sole discretion.
  • The approximate retail value of each prize package is $4,500.
  • Winner and his or her guest must travel on the same itinerary and on the same dates. In the event the prize winner or his/her guest engages in behavior that, as determined by the Sponsor or Sponsor’s representative at its sole discretion, is obnoxious or threatening, illegal, or that is intended to annoy, abuse, threaten, or harass any other person, Sponsor or Sponsor’s representative reserves the right to terminate the experience in whole or in part, with no further compensation.
  • Travel must be round trip from/to the Participating Hub. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor’s airline carriers of choice as detailed in the passenger ticket contracts.
  • Unless a child of the winner, travel companions must be eighteen (18) years of age or older as of the date of departure.
  • All travel arrangements will be made by a Sponsor-designated representative whose decisions regarding the itinerary are final and binding. Selection of airline, airport and hotel shall be at the discretion of Sponsor or any other provider of any portion of the prize. Trip winner and travel companion must have valid travel documents (e.g., government issued I.D., passport, etc.) along with any other travel requirements in order to travel prior to departure, and failure to do so may result in forfeiture of prize. Winner and his/her travel companion are solely responsible for satisfying all legally required conditions of travel including COVID-19 Protocols. Winner must have a valid major credit card to check in to a hotel. Winner is responsible for all incidental expenses while staying at hotel. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation or delay or any weather or airline issues that prevent the prize winner and travel companion, if applicable, from traveling.
  • The winner is responsible for all other costs and expenses associated with and/or not specifically included in the prize.
  • The flights and hotel accommodations must be booked no less than 30 days out from when winner selects to travel. Blackout dates may apply. All reservations are based on availability.

Prizes are non-transferable and non-refundable, and no substitutions will be made except as provided herein, at the Sponsor’s sole discretion. Prize is not redeemable for cash, unless otherwise specified herein. Sponsor reserves the right to substitute a particular prize for one of comparable or greater value. Winner is responsible for any and all applicable local, state, and/or federal taxes and fees (if any). Prize details are at Sponsor’s sole discretion.

Prizes for Sweepstakes include only those items expressly listed above in the applicable description of the prize. Any costs associated with the use or ownership of any prize is the sole responsibility of the winner. Prize is awarded “as is” with no warranty or guarantee express or implied by Sponsor and/or Administrator. Sponsor and/or Administrator disclaims all and any liability for the actual provision, quality or nature of any third-party product or services accepted by the winner. The awarding of any prize is contingent upon full compliance with these Official Rules. Entrants agree to be bound by Official Rules and agree that if winner fails to provide proof of identity, refuses to provide required signed documents listed below in Section 7 “Release”, is found to have violated the Official Rules or otherwise does not meet eligibility criteria, prize will be forfeited and awarded to an Alternate Winner. Entrants understand that neither Sponsor nor Administrator is liable for injuries, losses or damages of any kind arising from participation in this Sweepstakes and acceptance, possession and use of prize. Neither Sponsor and/or Administrator is responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize. Decisions of Sponsor and/or Administrator are final and legally binding in all respects.
Acceptance of prize shall constitute winner’s agreement and consent to Sponsor’s and its designees’ use of any winner’s name, city, state, likeness, photo and/or prize information in connection with this Sweepstakes for promotional, advertising or other purposes, in any manner, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.

6. How to Enter:

  1. Scan the QR code found on Sponsor advertising during the Sweepstakes Period. The QR code will direct you to https://bonaireisland.com/flash-flamboyance/enter/ (Sponsor’s “Sweepstakes Site”)
  2. Complete the required information on Sweepstakes registration form, including selecting the Flash Flamboyance Event you attended from the dropdown bar, agree to the Official Rules, and submit (“Eligible Entry”). Proof of delivery or receipt of entry will not be deemed by the Sponsor as proof of entry into the Sweepstakes. All entries become the sole property of Sponsor and will not be returned or acknowledged. All entries are subject to verification and approval by the Sponsor. Entries that do not meet the requirements for the entry specified below or otherwise do not comply with the Official Rules herein will be disqualified. Any attempted form of entry other than as described herein is void. Sponsor will determine in its sole discretion, what constitutes a valid entry.

Limit: You may enter one (1) time during the Sweepstakes Period. Entries generated by script, macro, AI, or other automated means or any means that subvert, or are likely to subvert, the entry process will be void.

7. Release:

By entering, you agree to release and hold harmless Released Parties (as defined below) from and against any and all liability, claim or cause of action, including, but not limited to, injuries, death, loss or damage of any kind arising from or in connection with this Sweepstakes or receipt or use or misuse of any prize.

The prize winner will be required to sign and return properly executed documents issued by the Administrator, which shall include: (a) an Affidavit of Eligibility or Declaration; (b) a Publicity Release (granting Sponsor the right to use the name and image of the winner for advertising and promotion purposes, unless prohibited by law); (c) a liability release; and (d) a form W-9, Taxpayer Request for Identification (U.S. winner only), to the Administrator within four (4) business days of attempted notification as a prerequisite for receiving the prize. Failure to comply with this deadline shall result in winner’s forfeiture of the prize.

If the selected Winner is unable to accept a prize in its entirety for any reason, the selected Winner will forfeit the prize and the prize will be awarded to an Alternate Winner. All prizes are guaranteed to be awarded, assuming a sufficient number of entries are received.

8. General Conditions:

Sponsor reserves the right to cancel, suspend, and/or modify this Sweepstakes, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of this Sweepstakes, as determined by Sponsor in its sole discretion. If the Sweepstakes is terminated, Sponsor may, in its sole discretion, determine winner from among all non-suspect, eligible entries received up to time of such action or as otherwise deemed fair and appropriate by Sponsor. The Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering or attempting to tamper with the entry process or the operation of this Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner, and to void all associated entries.

9. Limitations of Liability:

Released Parties (as defined in Section 12 below), are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in this Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or this Sweepstakes; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of this Sweepstakes, the uploading, the processing or judging selection of entries, the announcement of the prize or in any Sweepstakes-related materials; (5) late, lost, garbled, misdirected, inaccurate, incorrect, undeliverable, damaged or stolen entries or mail; (6) costs associated with claiming or redeeming the prize; nor (7) loss or damages resulting from an entrant’s connection to the internet via any of the websites contained herein. Released Parties are not responsible for any incorrect, mistranscribed, misdirected or undeliverable entries, E-mail transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor assumes no responsibility for late, lost, incomplete, inaccurate or damaged entries, or undeliverable E-mails resulting from any form of active or passive E-mail filtering by a user’s Internet service provider and/or E-mail client or for insufficient space in user’s E-mail account to receive E-mail. Sponsor does not accept responsibility for any damage (whether material or non-material) caused to entrants, to their computer equipment or to data which is stored on them, or to their personal, professional or commercial activities. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor or Administrator. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed submitted by the person whose name the corresponding account is registered to. All decisions regarding the identity of the authorized registrant shall be made by Sponsor and Administrator in its/their sole discretion.

10. GOVERNING LAW/JURISDICTION:

The Sweepstakes is governed by, and will be construed in accordance with, the laws of the State of Florida, except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Florida if the controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in Florida. All proceedings brought pursuant to this paragraph will be conducted in the STATE OF FLORIDA. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

11. ARBITRATION PROVISION:

By participating in this Sweepstakes, each entrant agrees that any and all disputes the entrant may have with, or claims entrant may have against, the Released Parties relating to, arising out of or connected in any way with (i) the Sweepstakes, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement, will be resolved individually and exclusively in the courts of Florida.

12. By participating and winning a prize, entrants and winner agree to release and hold harmless Sponsor, Administrator, and each of their respective parents, affiliates, subsidiaries and agents, and their respective officers, directors, employees and agents (“Released Parties“) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize, including any travel or activity related thereto including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failure or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, application downloads; (e) any other errors or problems in connection with the Sweepstakes, including without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of Winners, the cancellation or postponement of the event; (f) injury, death, losses or damages of any kind to persons or property which may be caused directly or indirectly, in whole or in part, from entrants or Winner’s participation in the Sweepstakes or acceptance, receipt or use/misuse of the prize (including any travel or activity related thereto). Entrant and/or Winners further agree that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the entrant or Winner’s be entitled to receive attorneys fees. Released Parties are not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrants and/or Winner’s waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

13. If any provision of this document is deemed to be invalid, it shall be considered deleted herefrom and shall not invalidate the remaining provisions.

14. Winner’s List: Visit the Sponsor’s Sweepstakes Site after 10/17/23.

15. If you choose to participate in this Sweepstakes, we will request certain personally identifiable information from you including but not limited to name, address, daytime phone number, age and e-mail address. Participation in these activities is entirely voluntary. IF YOU DO NOT WISH TO SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION, PLEASE DO NOT ENTER THIS SWEEPSTAKES. We use this information to notify Sweepstakes winners and award Prizes.
